Terms of Service

Draft only. This is a starting template, not legal advice. Have a solicitor review and adapt it (especially the data protection, liability, and cancellation sections) before real agencies sign up. Replace [Company Name], [Company Address], and [Contact Email] with your details.

1. Who this agreement is with

These Terms of Service govern use of the RotaStars platform ("the Service"), provided by [Company Name], [Company Address] ("we", "us"). By creating an account you agree to these terms on behalf of the agency you represent ("you", "the Agency").

2. What the Service does

The Service lets a care agency record points-based rewards for its staff, let staff view their points balance, and request cash-outs, which the Agency's admin(s) then action outside the Service (e.g. via payroll).

3. Accounts and responsibilities

You're responsible for the accuracy of information entered into the Service, for keeping login credentials secure, and for how your organisation's admins use staff data within it. You must have a lawful basis to process your staff's personal data through the Service (see our Privacy Policy).

4. Free trial and subscriptions

New agencies receive a free trial period as shown at signup. Continued access after the trial requires an active paid subscription. Subscriptions renew automatically each billing period until cancelled. You can cancel or manage your subscription at any time from the Billing page.

5. Fees and payment

Fees are as displayed at checkout and are billed in advance. Failure to pay may result in suspended access to the Service until the issue is resolved, without affecting your data, which is retained per our data retention practices.

6. Data ownership

You own the data you enter about your agency and staff. We act as a data processor on your behalf for that data - see the Privacy Policy for details. You can request an export or deletion of your Agency's data at any time.

7. Acceptable use

You agree not to misuse the Service, attempt to access another agency's data, or use the Service for any unlawful purpose.

8. Availability and support

We aim to keep the Service available but do not guarantee uninterrupted access. [Describe support channels/SLA here if you offer one.]

9. Liability

[This section needs proper legal drafting - it typically limits liability for indirect losses and caps liability at fees paid, but the right wording depends on your jurisdiction and risk appetite.]

10. Termination

Either party may terminate as described here. [Add specifics - notice period, effect on data, etc.]

11. Changes to these terms

We may update these terms from time to time; we'll let you know of material changes.

12. Contact
